ILCs: IMPROVEMENT LOCATION CERTS

This section will explain the purpose of Improvement Location Certificates, the procedure to request a survey proposal, how our consultation process works and any additional information needed to perform the survey.

What is an Improvement Location Certificate?

 

An Improvement Location Certificate (ILC) is not a survey, and should not ever be construed or confused as being a monumented land survey, Land Survey Plat, or Improvement Survey Plat.  It is a certificate prepared by a Professional Land Surveyor for the use of a client and is prepared based upon such surveyor’s general knowledge of the boundaries and monuments in a given area.  ILCs are most generally associated with the sale of a residence in Colorado, and Paragraph 7.3 of the standard Colorado Real Estate Contract addresses this need. 

Why would I need an Improvement Location Certificate?

When the title to real property is conveyed, there is usually both a title insurance company and a lender involved.  One or both of these entities may require a basic inspection of the property by a Surveyor to approximate whether there are any encroachments onto the deed lines of the property being conveyed or from the property being conveyed over the deed lines of the adjoining property(ies).  To satisfy these needs, a Surveyor will provide a graphic exhibit of the deed lines and will depict improvements to the property relative to the deed lines.  This graphic representation together with a standard certificate provided for in Colorado Revised Statutes 38-51-108 is called an Improvement Location Certificate.   

In most cases, an ILC will fulfill the requirements for transfer of the fee simple interest in the property.  However, if there are visible and apparent encroachments, a higher order survey will most likely be advised.  At your request, RM Meridian will coordinate directly with your lender and/or title officer to provide them with information necessary to find a resolution to the issue(s) encountered.

In order to best serve you, we will need to know the address of the subject property at a minimum, and preferably also the legal description.  We will also want to know your deadline for receiving the certificate.  RM Meridian will provide you with a formal proposal that clearly and concisely outlines the scope of work to be performed, the timeline to complete the task, and a cost to perform the work.
